TERMS AND CONDITIONS
Object
These general conditions of sale (the “General Conditions of Sale” or “CGV”) apply to any purchase by an end-user customer (hereinafter “the Customer”) of a product offered by AIR ET SANTÉ on the website www .air-et-sante.fr (hereinafter “the Site”).
Therefore, any order for a product offered for sale on the Site constitutes full acceptance of these General Terms and Conditions by the Customer, who declares having read them and fully adheres to them, before placing their order.
AIR ET SANTÉ reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions will be those in force at the time of payment of the order made by the Customer.
1. Order
Any order constitutes acceptance of the prices and descriptions of the products and accessories (hereinafter “the Product” or “the Products”) available for sale.
Any dispute on this point will take place within the framework of a possible exchange and the guarantees mentioned below.
The company AIR ET SANTÉ undertakes to honor orders received on the Site, only within the limits of available stocks of the Products. If the Products are not available, AIR ET SANTÉ undertakes to inform the Customer. However, AIR ET SANTÉ reserves the right to refuse an order for legitimate reasons.
2. Delivery
The Product ordered on the Site will be delivered in mainland France (including Corsica) to the Customer's personal address. Certain other French territories and departments are deliverable subject to acceptance of delivery quotes.
European countries are all covered by the delivery possibilities of the AIR ET SANTÉ Company. If the countries are not part of the drop-down menu of destination choices, they are for the moment excluded from the offer proposed by AIR ET SANTÉ on the website, but can be delivered upon simple request and quote.

For delivery to an address different from the billing address, the delivery address fields must be completed at the time of ordering in the delivery choice section.
Deliveries are made by Colissimo post: delivery within 3 days *, after preparation of the package and from its dispatch date.

In the event of absence, a delivery notice will be left by the carrier indicating where and when to collect the package.
In all cases, it is essential to check the condition of the package as well as its contents.
In the event of an incident, delivery must be refused with mandatory inclusion of the following information on the receipt:
• the words “refused due to poor condition”
• the date of receipt
• Signature.
At the same time, Customer Service must be contacted on the Site. If the observation is made after delivery (maximum period of 3 days from the date of receipt of the goods), Customer Service must also be contacted, and they will tell you the procedure to follow.
Cost of Delivery: Delivery is fully covered by the company AIR ET SANTÉ.
3. Payment terms
Payment for purchases is made online when ordering by:
• Bank card: Visa, Mastercard, American Express or Carte Bleue (Blue card)

• Bank transfer
AIR ET SANTÉ has implemented all means to ensure the confidentiality and security of data transmitted over the internet. As such, the Site uses a secure payment module such as 3D SECURE.
4. Prices
Prices are quoted in euros all taxes included.
They take into account the VAT applicable on the day of the order.
Prices are firm at the time of the Customer's order within the limits of available stocks.
If one or more taxes or contributions, particularly environmental, were to be created or modified, upwards or downwards, this change could be reflected in the sales price of the Products present on the Site, as well as in the sales documents.
5. Product Warranty
The Product is repairable or interchangeable by AIR ET SANTÉ for a period of 2 years.
This Product is guaranteed by AIR ET SANTÉ against any manufacturing defect during the warranty period from the date of delivery.
The warranty covers all costs of restoring a Product recognized as defective to return it to its original specifications, through repair, labor, and possible replacement of defective parts.
AIR ET SANTÉ reserves the choice of offering a similar replacement Product in place of repairing the defective Product. Our obligations under this warranty are limited exclusively to such repair or replacement.
The warranty can only apply within the framework of normal use of the air purifiers, as well as with maintenance in accordance with the recommendations of AIR ET SANTÉ.
Terms :
The request must be accompanied by proof of purchase.
The Product must be sent by registered mail after having been adequately packaged.
The Guarantee exclusively covers Products purchased from AIR ET SANTÉ, and used for domestic purposes.
This warranty does not cover damage resulting from misuse, negligence, failure to follow instructions for use and maintenance, or unauthorized modification or repair of the Product.
This warranty does not apply to packaging or transportation problems during shipment of the Product by its owner. It also does not include normal wear and tear of the Product, nor the maintenance or replacement of consumable parts, nor the following cases :
• Use of unsuitable water or filter and UV lamp
• Improper replacement of filters or UV lamps (any replacement must be carried out in accordance with the instructions in the user manual)
• Entry of water or other products into air purifiers. (excluding devices designed for this use)
• Damage due to shock or overload
• Any accident linked to fire, flooding, etc.
• Professional use or in a workplace not intended for
• Damaged dashboard
• Damage resulting from lightning or electrical surge
• Damage or malfunction specifically due to use with voltage or electrical frequency not conforming to those specified on the nameplate or other local specifications.
In order to offer the best possible after-sales service and to constantly improve the satisfaction of its Customers, AIR ET SANTÉ may send a satisfaction survey to all its Customers whose Product has been repaired or exchanged.
6. Returns
Furthermore, in the event of non-conformity of the Product or defect (damaged or deteriorated item), the Customer benefits from a period of 15 days from the date of receipt or withdrawal of his order to request an exchange.
To do this, he must contact Customer Service by telephone on + 33 (0)9 72 64 67 16 (cost of a local call, Monday to Friday from 9:00 a.m. to 6:00 p.m.) who will inform him of the methods for returning his item.
The item must be returned in its original, complete packaging (accessories, instructions and other documents included in the packaging). AIR ET SANTÉ then undertakes to return to the Customer the item corresponding to their order within 10 days, from receipt by AIR ET SANTÉ of the item returned by the Customer in accordance with the above.
Products returned incomplete, damaged or damaged will not be taken back. Regardless of the warranty conditions, AIR ET SANTÉ remains bound by the legal guarantee of conformity mentioned for products L. 217-4 to L. 217-12 of the Consumer Code allowing any customer:
• to benefit from a period of one year from the delivery of the goods to act,
• to choose between repair or replacement of the good, subject to the cost conditions provided for by article L.217-9 of the Consumer Code,
• to be exempt from providing proof of the existence of non-conformity of the goods within twelve months following delivery of the goods, except for second-hand goods.
The company AIR ET SANTÉ also remains bound by the legal guarantee relating to hidden defects in the item sold, in compliance with the conditions provided for in products 1641 to 1648 and 2232 of the Civil Code, allowing the customer to choose between canceling the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.
7. Retraction of accessories and consumables
The Customer benefits from a right of withdrawal, that is to say, to renounce the purchase of a Product on the Site without giving a reason.
To exercise this right, the Customer's request must be made in writing within 30 days following the date of receipt of the Product.
It must include the following information:

The item must also be returned to the AIR ET SANTÉ warehouse within 14 days from the date of sending the letter (postmark as proof) or the withdrawal email to the following address:
AIR AND HEALTH - LDPI Logistique - 5 chemin de Malatrait, 38290 La Verpillière.
In the event of an order and withdrawal relating to several Products, a request must be made for each Product.Upon receipt of the item, AIR ET SANTÉ will reimburse the payments already received, as well as the shipping costs for returning the item.
IMPORTANT: Products returned incomplete, damaged or damaged will not be subject to any refund, even partial.
8. Signature and proof
In all cases, the online provision of the bank card number and the final validation of the order will constitute proof of the entirety of the said order in accordance with the provisions of the law of March 13, 2000 and will constitute payment of the sums incurred by the seizure of the Products appearing on the order form.
This validation constitutes signature and express acceptance of all operations carried out on the Site.
Concerning payment by check or bank transfer, the order will be validated when the amount is collected.
9. Responsibility
The company AIR ET SANTÉ has, for all stages of order taking as well as for stages subsequent to the conclusion of the contract, an obligation to achieve results.
This obligation of result concerns only the supply and delivery of AIR ET SANTÉ Products and in no case the results after use of the AIR ET SANTÉ Products.
Thus AIR ET SANTÉ undertakes to describe the Products sold on the Site, and cannot be held responsible for inappropriate use not provided for in the documentation provided with said Products.
Furthermore, the liability of the company AIR ET SANTÉ cannot be incurred in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract, particularly in the delivery process, or to a case of force majeure as defined by French Jurisprudence.
Likewise, the company AIR ET SANTÉ cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.
The photographs of the Products presented on the Site are not contractual.
10. Nominative data
The company AIR ET SANTÉ collects personal data for the processing of the Customer's order and may communicate them to partners involved in the order processing chain. On the other hand, the company AIR ET SANTÉ undertakes not to communicate any individual information for commercial purposes.
11. Use of cookies

12. Intellectual property
All elements of the AIR ET SANTÉ website Store (www.air-et-sante.fr), whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.
13. Protection of minor children (children under 18 years old)
AIR ET SANTÉ does not knowingly market its Products and services to minors nor knowingly solicit or collect personal data provided by minors or relating to minors without the consent of a parent or guardian.
If it were to learn that the person submitting personal data through part of the AIR ET SANTÉ site was a minor, AIR ET SANTÉ would do everything reasonably in its power to have this personal data deleted on as quickly as possible from its files.
AIR ET SANTÉ undertakes to ensure that this personal data is not used for any purpose or communicated to third parties.
14. Entirety
In the event that one of the clauses of this contract is null and void due to a change in legislation, regulations or a court decision, this will in no way affect the validity and compliance with these General Terms and Conditions.
15. Duration
These General Terms and Conditions apply for the entire duration of the online availability of the Products offered by the company AIR ET SANTÉ.
16. Evidence
The computerized records, kept in the computer systems of the company AIR ET SANTÉ and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments made between the parties.
17. Conservation and archiving of transactions
The archiving of purchase orders and invoices is carried out on a reliable and durable medium in accordance with article 1348 of the Civil Code.
18. Applicable law and jurisdiction
These General Terms and Conditions are subject to French law.
In the event of a dispute relating to these General Terms and Conditions, an amicable solution will be sought before any legal action.
The Customer may also contact the Paris Mediation and Arbitration Center (“CMAP”) as a mediator for any complaint regarding the sale of an item purchased on the Site, subject to compliance with the conditions of admissibility of his request.
